Affiliate Program Terms & Conditions

1. Definitions

1.1          In this Affiliate Program Terms & Conditions:

(a)           a Direct Referral occurs when a Creator or Client provides a third party ("First Person") with a Unique Affiliate Link and the First Party uses the Unique Affiliate Link to create a Kite.site Account;

(b)           First Person Referrer means a person who provides a Direct Referral; 

(c)           Referral means either a Direct Referral, Second-Level Referral or Third-Level Referral;

(d)           a Second-Level Referral occurs when the First Party provides a third party ("Second Party") with a Unique Affiliate Link and the Second Party uses the Unique Affiliate Link to create a Kite.site Account; 

(e)           Second Person Referrer means a person who provides a Second-Level Referral;

(f)            a Third-Level Referral occurs when the Second Party provides a third party ("Final Party") with a Unique Affiliate Link and the Final Party uses the Unique Affiliate Link to create a Kite.site Account; and

(g)           Third-Level Referrer means a person who provides a Third-Level Referral;

(h)           Unique Affiliate Link means a link provide by Kite.site to a Creator who meets the eligibility criteria in clause 3 of these Affiliate Program Terms & Conditions which is used by the third party to create a Kite.site account.

2. Introduction

Welcome to the Kite.site Affiliate Program ("Program"). This Program allows Creators who maintain an active subscription to earn commissions by referring new Creators to Kite.site through unique affiliate links provided by Kite.site ("Affiliates"). These terms and conditions govern your participation in this Program.

3. Eligibility and Enrolment

3.1          Affiliate Status Eligibility: To participate as an Affiliate, you must:

(a)           have an active subscription to Kite.site; and

(b)           owe no outstanding Subscription Fees to Kite.site.

4. Commission Structure

4.1          Creators who are eligible to participate in the Program will receive a commission in accordance with the below table based upon the type of Referral that occurs ("Commission").

4.2          Referrals are tracked by Post Affiliate Pro.

4.3          Commissions are calculated as a percentage of the Subscription Fee that is paid by the Creator that is referred to Kite.Site. The Commissions for a Referral are:

(a)           for a Direct Referral, 15% of the relevant Subscription Fee;

(b)           for a Second-Level Referral, 10% of the relevant Subscription Fee; and

(c)           for a Third-Level Referral, 5% of the relevant Subscription Fee.

4.4          Commissions are calculated in accordance with the below table:

 4.5          Commission Payments: Commissions are calculated monthly based on active subscription payments and are paid through the Affiliate's Stripe Connect account.

5. Promotion Guidelines

5.1          Affiliates are encouraged to use the following authorised methods to promote Kite.site and attract potential new Creators through their Unique Affiliate Link:

(a)           Social Media Content: Sharing information about Kite.site through posts, videos, or articles on platforms such as Facebook, Instagram, Twitter, LinkedIn, and YouTube.

(b)           Email Marketing: Sending emails to any subscribers who have opted in to receive communications from the Affiliate.

(c)           In-Person Events: Promoting Kite.site during workshops, seminars, or events or meetups where potential Creators are present. This includes distributing materials containing the Unique Affiliate Link or presenting features of Kite.site.

(d)           Personal Communications: Sharing the Unique Affiliate Link through personal networks.

6. Unauthorised and Discouraged Methods of Promotion

6.1          Affiliates must avoid any promotional tactics that are unlawful or could be considered unethical, manipulative, or coercive. Prohibited methods include:

(a)           Spamming: Sending unsolicited messages or communications in bulk.

(b)           Misrepresentation: Making false or misleading statements about Kite.site.

(c)           Manipulative Tactics: Employing deceptive practices to encourage people to create an Account.

(d)           Infringing on Intellectual Property: Using unauthorised materials such as logos, trademarks, or copyrighted images of Kite.site without permission.

(e)           Adware and Malware: Using software that installs itself on a user’s device without their knowledge.

7. Payment Procedures

7.1          Stripe Connect Payments: All Affiliate payments will be made exclusively through Stripe Connect. Affiliates must maintain an active and compliant Stripe Connect account.

7.2          Maintaining Stripe Account: Affiliates are responsible for any disruptions to their Stripe account that affect payment processing.

8. Payments and Taxes

8.1          Inclusive of Taxes: All affiliate payments include any relevant local taxes that Affiliates are responsible to charge Kite.site. Affiliates are responsible for any further tax obligations within their jurisdictions.

9. Termination and Fraud Prevention

9.1          Revocation of Affiliate Status: Kite.site reserves the right to revoke an Affiliate's status or withhold commissions if fraudulent or unethical behaviours are detected.  

9.2          Ethical Conduct: Affiliates are expected to adhere to ethical promotion practices and comply with all applicable laws and regulations.

10. Amendments to Terms

10.1       Kite.site may amend these terms at any time. Continued participation in the Program after such amendments constitutes acceptance of the new terms.

11. Acceptance

11.1       By participating in the Program, you agree to these terms, ensuring a clear understanding of your rights and responsibilities.
